These General Terms and Conditions do not contravene to consumers' mandatory statutory rights. Please, read these General Terms and Conditions carefully. When you book your holiday with OBS d.o.o, trading as MountVacation.com, you are agreeing with the terms and conditions as stated on this page.

Our registered office is at Letaliska 29, 1000 Ljubljana, Slovenia. No employee or representative of this company has the authority to alter these booking conditions. Your contract shall be governed by and construed in accordance with Slovene Laws and is subject to the jurisdiction of Slovenian courts.

These booking conditions govern bookings made on the internet, through our telephone reservations team or via any other third party agent and you will be deemed to be bound by these conditions on confirmation of your booking through any of these channels. You confirm you are aged 18 or over and are responsible for any payments made through your preferred method. It is your responsibility to ensure you have sufficient funds to complete the transaction, and you have the correct authority to act on behalf of the credit/debit card holder, where applicable.

Validity of the General Terms and Conditions

The website MountVacation.com and OBS d.o.o. (MountVacation.com) offers its services exclusively on the basis of these General Terms and Conditions. The General Terms and Conditions provisions govern the legal relationship between you as customer and MountVacation.com and constitute part of the contract between you and MountVacation.com. MountVacation.com regularly operates solely as an internet broker and not as a broker of distinct accommodation services

MountVacation.com will operate solely as an intermediary between you and respective service providers, such as hotel operations, and acts on behalf and to the account of both, you and the respective service provider. Insofar as MountVacation.com offers internet links to third-party offers in the course of individual transactions, MountVacation.com does not operate as an intermediary of those third-party services. Please be advised that price, conveyance, and general travel conditions of the relevant individual service provider(s) will apply to the contents of the agreement between you and the service provider(s). These conditions may govern the conditions of payment, deadlines, liability, cancellation, booking alterations, reimbursement as well as other details of the hotel agreement, for clarification purposes only.

Website Accuracy

Service providers and partners are solely responsible for uploading accommodation descriptions, photos, prices and general information onto the MountVacation.com website. Mountvacation.com does not guarantee the accuracy, completeness or correctness of any information or prices on its site. You agree that the use of the site and its contents is entirely at your risk. The content and information provided by MountVacation.com on this Web Site is not intended to be advice of any kind.

MountVacation.com’ service providers and partners make every reasonable effort to provide accurate and up-to-date information about the products and services they provide. However, the information is subject to change without any prior notice. Therefore, you should regularly check the current terms and conditions of specific products and services for any possible amendments.

A product or service shown on this website may not necessarily be suitable for you - this is for you to decide (if in doubt, you may wish to seek appropriate independent advice).

Mountvacation.com or its accommodation and service providers may correct any errors or omissions or change the format or content of the site at any time. Routine maintenance, demand on systems and other circumstances mean that this website and the services provided on it may not always be available.

Where an accommodation is described as having skiing to/from the door (ski-in/ski-out), this is subject to the snow conditions at the time as well as to the individual skier's ability. For other holidays, swimming pools may be temporarily unavailable, or a hotel may decide to change meal service arrangements. These are by way of example only, and there may be other similar changes made in the resort. Many images are included for their appearance and general relevance. Distance is quoted in time taken to walk by and in good weather conditions in standard footwear. Timings will vary according to the footwear, age, personal fitness as well as surface conditions.

MountVacation.com, the portal (website), has been compiled with the greatest possible care. Our services are based on the information provided by the hotels and service providers; for this reason, the hotels and service providers remain responsible for the correctness of this information. Hotels and service providers can alter the information about their hotel or services, such as prices and availability, at any moment. We therefore cannot guarantee that all the information is accurate or faultless, nor can we be held responsible for errors or inaccuracies in the supplied information. You should always check the provided information before acting on the basis of the supplied information.

MountVacation.com will not be liable, under the terms of this disclaimer or otherwise, for any loss of profit, loss of revenue, loss of contract or any other indirect or consequential loss you may suffer as a result of the use of any of the information contained in the Web Site.

MountVacation.com which operates solely as an intermediary, supply any guarantee for the availability, descriptions, photos or current rates of the accommodation and service providers.

Pricing

The on-line prices are calculated as accurately as possible according to the information input by you the client and the information input by individual accommodation and/or service providers. However, because of the complex nature of the calculations as well as the numerous different combinations of rooms, packages and services, MountVacation.com cannot guarantee the online prices. All rooms and prices on the website are subject to availability.

After a booking has been confirmed and in the event of an incorrect price, we will not be bound by this and will issue a revised booking contract or invoice showing the correct amount. Any alterations to a booking will be made no less than 7 days before the check-in date. In the unlikely event that we are unable to confirm your booking or you do not accept the revised booking contract, the following options will be available to you:

  • to accept alternative accommodation, service or holiday package offered by us, or
  • to purchase another holiday at the current website selling price from us, or
  • to accept a full refund of all monies paid

You must tell us the option you wish to accept within 48 hours of the offer being made; otherwise we will assume you have chosen to accept the alternative holiday offered. Whichever option you choose, a confirmation invoice will be sent as soon as possible and, if you do not wish to proceed, we will refund all monies paid within 7 days.

Price Guarantee

Best price guaranteed.Price guarantee applies to the basic service, that is the accommodation price, and does not include any additional charges payable on site. If you find a better or equal price on the same accommodation with the same booking conditions, we will match it! You just have to report to us in writing the details of the site or agent where you saw the price discrepancy within 24hrs of your booking and we'll refund the difference!

Use of the site

You may only use the website to make legitimate enquiries or bookings. You are not permitted to make any speculative, false or fraudulent bookings or any booking in anticipation of demand. If we are reasonably of the opinion that such a booking has been made we shall have full right to cancel the booking and inform the relevant authorities of the respective countries.

You also undertake to provide correct and accurate email, postal, personal and/or other contact information to us and give us the right to use these details to contact you in case that it should prove to be necessary (see our «Privacy Policy»). If you do not give us all of the information that we need, we may not be able to complete your booking. You shall be liable to us for any costs sustained due to any speculative, false or fraudulent bookings and/or contact and personal information made or given by you.

Your Booking Contract

This website is intended only as an invitation and it does not constitute an offer by MountVacation.com. Any booking made by you shall be deemed to be a binding offer by you which we may, at our choice, accept. No contract shall exist until your payment obligations are met as every accommodation provider has set them directly to MountVacation.com system.

A booking is established at the completion of the booking steps whereby you click on the appropriate button(s) in the booking process on our website or whereby an offline booking has been made and confirmed to you in writing via email. You are bound to this booking for a maximum of 48 hours. If neither, MountVacation.com nor the respective accommodation and/or service provider confirm the booking within 48 hours following the completion of your booking, you are no longer bound by these terms & conditions. A booking confirmation sent to you in writing will serve as acceptance of the booking and to these terms & conditions.

A booking confirmation will generally be sent immediately to your email address following the completion of the booking together with the booking-reference number. Accommodation and/or services providers hold the right to cancel a booking within 48 hours from when you receive written confirmation for an undefined reason.

Booking Details

Once a booking has been confirmed you are bound by these terms and conditions. A booking contract and confirmation of your booking will be sent the same day or in some cases the following working day. Please note that it is your responsibility to check carefully the details of your booking as soon as you receive them, and to notify us of any errors.

Please check that all names, ages, dates as well as timings are correct upon receipt of a booking contract and/or written confirmation and advise us of any errors within 24 hours. Any changes to these details made 24 hours after receipt of a booking contract and/or written confirmation are likely to incur amendment fees.

The booking information that you provide to us will be passed on only to the relevant accommodation and/or service providers of your travel arrangements or other persons necessary for the provision of your travel arrangements. If we cannot pass this information to the relevant accommodation and/or service providers, we will be unable to provide or confirm your booking. In making this booking, you consent to this information being passed on to the relevant persons. Full details of our data protection policy are available on our website

Payment

During the booking process the system guides you through payment conditions that ever accommodation provider has set them for every offer. Failure of payment terms may be the reason of cancellation without prior notice.

Bookings made off line via email or via telephone and not online through the MountVacation.com website may incur a 25 € offline administration booking fee.

Personal details such as credit card numbers, names, addresses and telephone numbers are protected by Secure Sockets Layer (SSL) encryption technology during the entire booking process.

Amendments and cancellations made by a customer

If amendments are made after a booking contract has been issued and you wish to alter your travel arrangements in any way (your chosen departure date or accommodation, for example), we will do our utmost to effect these changes. However, it may not always be possible in all cases. Any request for any change to be made must be made in writing via email at cs@mountvacation.com by the person who made the booking or by your travel agent. We will only cancel your booking with the booked accommodation and/or service provider the day we receive your written communication.

Bookings made off line via email or via telephone and not online through the MountVacation.com website may incur a 25 € offline administration booking fee.

You should be aware that these costs could increase the closer to the departure date that the changes are made. Additionally you should contact us as soon as possible. Following any amendment or cancellation, it may take up to 24 hours for MountVacation.com to communicate any intention to cancel or amend a booking with the accommodation and/or service provider.

If the dates of an original booking are amended in any way and confirmed with the same accommodation or service provider and MountVacation.com later receives a request to cancel the booking, then the cancellation fees and conditions outlined in the General Terms & conditions may not apply and will be at the discretion of the accommodation and/or service provider. In these instances the cancellation fees will be calculated on a case by case basis.

If the reason for the cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges. Claims must be made directly to the insurance company concerned. Where any cancellation reduces the number of full paying members in the group (amounting to less than the number for which the price, and/or any discounts were agreed upon at the time of the original booking) MountVacation.com will recalculate these items and re-invoice you accordingly.

Please note that in case you should cancel any ski extras such as lift passes, equipment hire and ski lessons, the cancellation of such items are subject to the same cancellation terms and conditions of your holiday as detailed below. Cancellation terms and conditions of any extras booked will also be subject to our services providers.

General Cancellation Policy

The cancellation policy for confirmed bookings may vary depending on the accommodation and/or service booked. Individual accommodation or service providers may have a different cancellation policy to what is shown in MountVacation.com general terms and conditions. In this case, the accommodation and/or service provider will have their own cancellation policy shown on the hotel or service page on MountVacation.com website and therefore is accessible to every client before they book. In the case where the accommodation and/or service providers do not enter their own cancellation policy, MountVacation.com general cancellation policy will apply as follow:

Cancellations are charged as a percentage of the total cost (excluding partner fees, certain services, which are non-refundable) and which have been paid to MountVacation.com are as follows:

  • Your notice is received more than 30 days before departure = FREE CANCELLATION;
  • Your notice is received between 30 and 16 days before departure = 30% of total value of booking;
  • Your notice is received between 15 and 7 days before departure = 50% of total value of booking;
  • Your notice is received between 6 and 2 days before departure = 75% of total value of booking;
  • Your notice is received 1 day or less before departure = 100% of total value of booking.

In case the booking is cancelled upon the demand of the client, administrative costs of 25 € will be charged.

Individuals, however, shall not be entitled to any reimbursement in case of force majeure such as any natural causes or political unrest which caused impossibility to use the accommodation’s services. In case of such event occurring, it shall be deemed that the individual has withdrawn from the contract and MountVacation.com shall have a right to charge costs as defined in these terms & conditions.

Lack of snow or bad weather conditions are not a reason for cancellation. If you cancel your holidays for this reason then MountVacation.com will not reimburse any resulting expenses or additional costs. If you cancel your holidays, you will be charged accordingly as stated in these terms and conditions.

Alterations or cancellations made by MountVacation.com or a Service Provider

MountVacation.com’ accommodation and service suppliers upload prices and descriptions onto our web site many months in advance. Occasionally, our service suppliers have to make changes to correct errors in these details both before and after bookings have been confirmed. Bookings may be cancelled for any undefined reason within 48hours of arrival . Our accommodation and service suppliers may cancel or amend a confirmed booking based on this timeframe. Whilst MountVacation.com and our partners always attempt to avoid amendments and cancellations, amendments and cancellations may occur at any time within 48hours from confirmation of a booking.

Changes made by the accommodation and/or service provider may occur without prior notice and shall not affect any of your statutory rights. In no event shall MountVacation.com be liable for any changes of accommodation to an accommodation of a lower standard nor in the event where the change or cancellation has been caused by the accommodation provider without the consent of MountVacation.com or in the event of force majeure such as war, threat of war, civil strife, industrial action, terrorist activity, natural or nuclear disaster, fire, bad weather or technical difficulties with transport and any other incident that shall frustrate your travel. MountVacation.com will not be liable under any of the above circumstances and we will not pay any resulting expenses or additional costs.

Travel documents

All travel documents and vouchers (e.g. booking contracts/invoices/vouchers/insurance policies), in most instances, will be emailed to the email address provided at the time of booking. Once these documents or vouchers leave our offices, either by post or by email, we will not be responsible for their loss unless such loss is due to our negligence. If these documents need to be reissued please send your request in writing to cs@mountvacation.com.

After payment conditions have been met, you will receive all relevant travel documents electronically which you must print and present to the accommodation or service provider.

Medical Assistance Insurance

MountVacation.com and our service suppliers strongly recommend you to take out adequate travel insurance as a condition of booking with us to cover you and your party in the event of accident or illness; loss of baggage and money; and other expenses. If you purchase a policy through MountVacation.com please check it carefully to ensure that all the details are correct and that all relevant information provided by you is correct on the policy. (e.g. pre-existing medical conditions, travel dates, etc). All medical certificates are under the supervision of the insurance company. In case of insurance fraud, legal action will be taken against the physician as well as the client. Failure to disclose relevant information will affect your insurance. A Medical Assistance Insurance policy is available for purchase at www.mountvacation.com

One of the conditions should you not take out the insurance with us, indemnifying MountVacation.com against all costs, losses and liabilities that would have been covered by such insurance.

Complaints

Should you have any complaint about the accommodation or service provider services you booked through MountVacation.com, you must at once notify the residence, hotel reception, service provider or the relevant representative during the period of your stay. The accommodation and service suppliers must be given adequate opportunity to rectify the situation during your stay. If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to cs@mountvacation.com or via post at MountVacation.com, 12 Jožeta Jame, Lubljana 1210, Slovenia. You must include your booking reference number and all other relevant information including photos to support your complaint. Please keep your correspondence concise and to the point. This will assist us to quickly identify your concerns and speed up our response to you.

If you have not followed the above procedure, we will still do our best to help you. However, any liability may be diminished, ultimately to the extent that liability of the accommodation services shall be minimal or non-existent, if there is a failure to complain promptly in writing and without giving the service provider the opportunity to rectify the problem while the opportunity exists. None of the foregoing affects your statutory rights in any way. We endeavour to respond to all complaints within twenty one days.

Assignment of rights

These General Terms and Conditions of the contract are between you and us only. You are not entitled to assign or delegate your rights under them to any third person.

Intellectual property

All intellectual property and information on MountVacation.com website is ours or is licensed to us and you shall not copy these without our permission. This does not prevent you from using MountVacation.com website to the extent necessary to make a copy of any booking details.

Amendment of the terms and conditions

Each time you use MountVacation.com website, you will be bound by the then current General Terms and Conditions and you should review these each time you make a booking to insure you are satisfied with them.

Severability

These General Terms and Conditions shall be deemed severable. In the event that any provision is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by the applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

Headings

The headings used in these General Terms and Conditions are included for convenience only and shall not define, extend, limit or otherwise affect these General Terms and Conditions.

Entire agreement

These General Terms and Conditions constitute a binding contract between us and you should read them carefully and ensure they contain everything you want and nothing you are not prepared to agree to.

Applicable law

Your contract with MountVacation.com is based on these General Terms and Conditions and these terms represent part of the contract. You must agree with the General Terms and Conditions before continuing the process. The contract and the General Terms and Conditions are governed by the Laws of the Republic of Slovenia. Any dispute arising out of or in relation to this contract or the terms shall be in any case and notwithstanding the EU legislation resolved by the Courts of the Republic of Slovenia, unless you are a natural person and MountVacation.com will have to file a claim against you. In such case a law suit may be brought up against you at the court of your current domicile or permanent residence, unless you have changed your domicile or residence after confirming these General Terms and Conditions. Your statutory rights are not affected by anything in these General Terms and Conditions. The English version of these General Terms and Conditions, which is accessible at MountVacation.com under Terms and Conditions, is the authentic and/original version and shall be used in any dispute. All other language versions merely serve as a translation for convenience.

Data Protection & Privacy

MountVacation.com respects your privacy and is committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Personal Data Protection Act and relevant EU legislation).

We collect information about you for two reasons: First, to process your order. Second, to provide you with the best possible service.

Before you submit your accommodation proposal, we ask if we can send you occasional news or offers by email. We will not email you in the future unless you have given us your consent. We do, however, need to email you during the process of arranging your accommodation.

We will give you the chance to refuse email from us in the future. We do not send marketing emails to non-customer's personal email addresses ('spam').

The type of information we will collect about you includes:

Your name, age (to ensure correct allocation of hotel rooms/insurance pricing), name and age of other party members, your address, phone number, e-mail address, credit/debit card details.

Any personal information you supply will only be used for the purpose of arranging your holiday, and will not be given or sold to any third party under any other circumstances. We will never collect sensitive information about you without your explicit consent.

The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.

It is easy to subscribe and unsubscribe at any time, either by clicking the “unsubscribe” button on any of the promotional correspondences, or by sending us the email that needs unsubscribing or by amending via the contact form.

We will not give away, or sell your email address or any other personal details without your consent. Your email address is only used by us and you may from time to time receive communications from us in the form of newsletters and mailings.
